What does the District Attorney’s Office do?

The District Attorney’s duties are defined in the Georgia Constitution and by State law. The primary responsibility is to prosecute all felony crimes in the Superior and Juvenile Courts that occur in Forsyth County. These duties are carried out with a staff of attorneys, investigators, victim advocates and administrative support personnel.

What is the difference between a felony and a misdemeanor?

A misdemeanor is a crime that carries a maximum sentence of twelve months. A felony is more serious, carrying a minimum sentence of one year.

I am the victim and want to dismiss the case. What do I do?

Talk to the assistant district attorney assigned to your case. The prosecutor will consider your request, but may decide to prosecute the case if it is in the best interest of the community.

I received a subpoena. What do I do?

A subpoena is a summons that requires your attendance in court unless you are excused. Call the number provided on the subpoena to leave your email address and phone number. You will be placed on call. Someone from the District Attorney’s office will contact you to let you know if you will need to come to court.

The judge ordered the defendant to pay restitution to me, but so far I haven’t received anything. What do I do?

Contact the Department of Community Supervision at 770-781-2170 if the case is a felony. If the case is a misdemeanor, contact Georgia Probation Management at 770-844-8410.

I am a defendant. May I speak to an assistant district attorney about the case?

Call the office at (770) 781-2125 to schedule an appointment. If you have a lawyer, the District Attorney’s Office cannot talk to you.

What if I cannot afford an attorney to represent me?

Contact the Indigent Defense Office at 678-513-5959.

I think a crime has been committed. How do I bring charges?

Contact the law enforcement agency in the jurisdiction where the crime was committed.

My address has changed since my arrest? What do I do?
